How to get Investor Visa in USA with E5 immigrant Investor Visa?
The usa investor visa is a dream for many investors. An applicant must file Form I-526, Immigrant Petition by Alien Entrepreneur, with US Citizenship and Immigration Services to be eligible for an E5 immigrant investment visa (USCIS). See EB-5 Immigrant Investor, EB-5 Immigrant Investor Process, EB-5 Regional Centers, and Permanent Workers on the USCIS website for more information about qualifying as an immigrant investor and filing the Form I-526 petition.
Immigrant investors do not need to obtain a labor certification. Before applying for an immigrant visa at a US Embassy or Consulate abroad, the Form I-526 petition must be authorized by the USCIS.
Fees and Visa Application
The petition is transmitted to the National Visa Center after USCIS accepts it (NVC). The petition will be assigned a case number by NVC after it has been received. NVC will instruct an applicant to file Form DS-261, Choice of Address and Agent, when their priority date matches the most recent qualifying date. (NOTE: NVC will not tell you to fill out Form DS-261) if you already have an attorney.
The applicant’s case will be pre-processed by NVC, which will give the applicant information on how to submit the relevant fees. NVC will request that the applicant provide the relevant immigrant visa paperwork, including application forms, civil documents, and more, after the appropriate costs have been paid. Can My family members also receive immigrant visas?
Your spouse and minor unmarried children under the age of 21 may apply for immigrant visas alongside you if your petition is approved. They, too, must fill out required application forms, collect required civil documents, pay required fees, and submit to medical examinations, just like you.
Same-sex spouses of U.S. citizens and Lawful Permanent Residents (LPRs) are now entitled for the same immigration advantages as opposite-sex spouses, as well as their minor children.
Upon receipt of an accepted I-130 or I-140 petition from USCIS, consular officers at US embassies and consulates will adjudicate their immigrant visa petitions. Please check our Frequently Asked Questions for more information.
Numerical Limitations
Until the yearly numerical limit for the category is achieved, immigrant investor visas are issued in the order in which petitions were filed. A petition’s filing date becomes the applicant’s priority date.
An applicant’s priority date must be met before an immigrant visa can be awarded. In some extremely overloaded categories, there may be a several-year wait before a priority date is established. For the most up-to-date priority dates, consult the Visa Bulletin. You can study more about the limitations of the visa by visiting immigration law firm houston.
